This contains details of the Privacy Policy and Terms of Use of the system. In the statements below, AGEM CSU refers to Arden and Greater East Midlands Commissioning Support Unit. 

1. OWNERSHIP

The Hepatitis C Clinical Registry System is an application that has been developed by AGEM CSU in partnership with NHS England. It is developed, maintained, supported and hosted by AGEM CSU, but owned by NHS England, individual Providers are the data controller of their own data within the system.

AGEM CSU is acting as a commercial third party by providing the Hepatitis C Clinical Registry system and is legally regarded as a data processor i.e. it has no legal responsibility for any data that is processed other than to maintain the security and confidentiality of such data. 

Failure to accept the Terms and Conditions of this EULA will mean that access to the Hepatitis C Clinical Registry system is denied.

2. YOUR USE OF THE HEPATITIS C CLINICAL REGISTRY SYSTEM

AGEM CSU is committed to ensuring patient confidentiality through appropriate data security measures in relation to this application.

The following must be complied with:

Your organisation MUST maintain v11 (onwards) Information Governance Toolkit compliance at Level 2 across all requirements.

Users must maintain the confidentiality of their account and password by restricting access to their computer to prevent unauthorised access.

Users agree to accept responsibility for all activities that occur under their account or password.

Users shall take all necessary steps to ensure that their password is kept confidential and secure and shall inform AGEM CSU as set out in the Contact section immediately if they have any reason to believe that their password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

Users must not knowingly (or be encouraged to) use or share their Username and password. Where such an incident occurs in an organisation ALL users access may be suspended until assurances have been provided that appropriate action has been taken to resolve this matter.

Users must inform AGEM CSU if their role changes and they no longer need or are entitled to have access to the Hepatitis C Clinical Registry system by contacting the Support Desk (see ‘9. CONTACT’ below)

Please ensure that the details that you provide us with are correct and complete and inform AGEM CSU (see ‘9. CONTACT’ below) immediately of any changes to information that you have provided us.

3. ACCESS TO THE HEPATITIS C CLINICAL REGISTRY SYSTEM

We will use all reasonable endeavours (or as agreed as part of any Service Level Agreement) to ensure the availability of the Hepatitis C Clinical Registry system will be uninterrupted within working hours (8am – 5pm Monday – Friday). However, due to the nature of online technology this cannot be guaranteed.

Access to the Hepatitis C Clinical Registry system may also be occasionally suspended or restricted to allow for repairs, maintenance or the introduction of new facilities or services. As far as possible we will seek to limit the frequency or duration of any such suspension or restriction and will notify users in advance of any such suspension or restriction.

4. YOUR OBLIGATIONS IN USING THE HEPATITIS C CLINICAL REGISTRY SYSTEM

You must not use the Hepatitis C Clinical Registry system in any way that causes, or is likely to cause, the application or access to it to be interrupted, damaged or impaired in any way.
You understand that you are responsible for all electronic communications and content sent from your organisation to us.

You may not use the Hepatitis C Clinical Registry system for any fraudulent purposes or in connection with a criminal offence or other unlawful activity (the Computer Misuse Act 1990 and Data Protection Act 1998 both apply and will be strictly enforced by AGEM CSU). 

Access to the Hepatitis C Clinical Registry system will be immediately suspended by AGEM CSU should it consider that those access rights are being used inappropriately. 

The super user at each organisation will monitor user activity and where a user has been inactive for 30days or more they will contact the user to establish that their access remains valid; where it does not, they will inactivate the user immediately.

5. AGEM CSU LIABILITIES

AGEM CSU shall ensure that this EULA is strictly version controlled and that any and all potential amendments are notified to all end users of the Hepatitis C Clinical Registry system at least 28 days before those changes apply.


6. YOUR RIGHTS

You have the right to withdraw your personal account information from us at any time (please see Contact Section about how to do this). Thirty days after you notify us your personal account details will be permanently locked and/or deleted (but full audit trails of activity will be retained).

7. ADVERSE INCIDENT REPORTING

Should you notice that information provided by the Hepatitis C Clinical Registry system is incorrect, has been corrupted or is excessive based on your access rights you must report this as an adverse incident (see ‘9. CONTACT’ below).  

8. DATA QUALITY

It is important that patient records are complete and accurate at all times. There will be occasion whereby some data elements may not be known at the time of data entry and it is the responsibility of the system user to update records once further / correct information is known.
